Service Description

AdzSpark offers email marketing services designed to assist clients in promoting their products or services via email campaigns. These services may include email list management, campaign design, content creation, delivery scheduling, analytics reporting, and other related activities.

Client Responsibilities

• Provide accurate and up-to-date information necessary for the creation and execution of email campaigns.
• Comply with all applicable laws and regulations, including those related to email marketing, privacy, and data protection.
• Obtain any necessary permissions or consents from recipients before sending marketing emails.
• Refrain from engaging in any activities that may harm the reputation or deliverability of AdzSpark's email services.

Intellectual Property

All intellectual property rights associated with AdzSpark's email marketing services, including but not limited to software, templates, designs, and content, are owned by the Service Provider. Clients retain ownership of their own content and grant AdzSpark a license to use such content solely for the purpose of providing the Service.

Payment Terms

Clients are responsible for paying all fees associated with the use of AdzSpark's email marketing services as outlined in the pricing plan or contract. Payments are due in accordance with the agreed-upon schedule, and failure to pay may result in the suspension or termination of the Service.

Privacy and Data Protection

AdzSpark is committed to protecting the privacy and security of client data. We will not disclose or share client information with third parties except as necessary to provide the Service or as required by law. Clients are responsible for complying with all applicable data protection laws and regulations.

Termination

Either party may terminate this Agreement at any time for any reason by providing written notice to the other party. Upon termination, clients may be responsible for paying any outstanding fees for services rendered up to the termination date.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. AdzSpark disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event shall AdzSpark be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service, including but not limited to loss of profits, data, or business interruption.

Amendments

AdzSpark reserves the right to modify or amend this Agreement at any time. Any changes will be effective upon posting on the AdzSpark website or notification to clients. Continued use of the Service after such modifications constitutes acceptance of the updated Agreement.
